Terms of Use

Plain English: use the site and the beta sensibly, your videos are yours, the beta is unfinished software, and we can't promise it will be perfect.

What these terms cover

These terms apply to this website, vbcut.com, and to participation in the VBCut beta program. They are an agreement between you and RayCave Holdings, LLC, a New Mexico limited liability company ("we", "us").

The VBCut application itself, once distributed through Apple's App Store, is licensed to you under Apple's Licensed Application End User License Agreement unless we provide a different license with it. Where that agreement and these terms conflict as to the app, that agreement governs the app.

The website

You may read, use, and link to this site freely. Please don't attempt to disrupt it, gain unauthorized access to it, or scrape it in ways that degrade it for other people. The site's text, layout, and the VBCut name and logo belong to us; the underlying facts and ideas do not, and you're welcome to describe what the app does in your own words.

The beta program

Beta software is unfinished by definition. If you take part:

Your videos and your content

Your footage is yours. VBCut processes video entirely on your own device, and we never receive it — we have no servers that could. We claim no license, ownership, or interest in anything you record, edit, or export.

You are responsible for having the right to record and share the footage you use, and for following the rules of the venues, leagues, and tournaments you film at. Many youth sports organizations have their own filming and sharing policies; those are between you and them.

Acceptable use

Don't use VBCut or this site to break the law, to harass or surveil anyone, or to violate someone's privacy. Don't attempt to reverse engineer, decompile, or circumvent technical restrictions in the app except where the law expressly permits it despite this limitation.

No warranty

The site and the beta software are provided "as is" and "as available", without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the app will detect every rally, that results will be uninterrupted or error-free, or that defects will be corrected.

Some jurisdictions do not allow the exclusion of certain warranties, so some of the above may not apply to you.

Limitation of liability

To the fullest extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost data, or lost recordings, arising out of or relating to your use of the site or the beta software. Our total liability for any claim relating to the site or the beta will not exceed the greater of the amount you paid us in the twelve months before the claim, or one hundred U.S. dollars.

Some jurisdictions do not allow certain limitations of liability, so some of the above may not apply to you.

Changes

We may update these terms. If we make a material change, we'll update the effective date above and, for beta participants, note it in the release notes or by email. Continuing to use the site or the beta after a change means you accept the updated terms.

Governing law

These terms are governed by the laws of the State of New Mexico, without regard to its conflict-of-laws rules. Any dispute will be brought in the state or federal courts located in Bernalillo County, New Mexico, and you and we each consent to the jurisdiction of those courts. Nothing here limits any right you may have to bring a claim in a small claims court.
